The author is an eminent public interest lawyer in the Supreme Court of India. He is also an activist and a founder member of Swaraj Abhiyan.
The book (first published in 1978) focuses on the day-to-day proceedings lucidly, bringing out the matters carefully along with legal and political implications that led to 21-month period long Emergency. It also discusses various legal principles relating to constitutional, election and various procedural laws.
The election petition which led to this historical case was initially instituted because the defeat made Mr. Raj Narain believe that the rumours of ballot papers being treated with chemicals are true.
The case is important for several reasons. It was the first time in independent India’s history that a PM’s election was set aside. It was also the first time that a constitutional amendment was struck down on the basic structure doctrine that was propounded in Kesavananda Bharti Case.
Rich in political and legal history, this book is a must read for all the law students.
